  • Even if you proceed with foreclosure, taxes may follow

    I thought that if I failed to pay the mortgage and went through foreclosure, all the debts related to the mortgage would be gone. But today, after reading an article on realtor.com, I learned something new and want to share it with my customers. First of all, everyone knows about foreclosure, right? If the landlord is unable to repay the mortgage loan, the bank that issued the loan forecloses the property, sells it, and pays for the damage. Therefore, if you proceed with foreclosure, of course the debt with the bank will be settled. But, what kind of organization is the IRS? Of course, we have to pay taxes on this part. In other words, the amount of mortgage forgiven through foreclosure is set as income and tax is imposed on it. Usually, if you do a foreclosure, you will receive a 1099-C (Cancellation of Debt) from the bank that held the loan. The amount of canceled debt listed here is income. However, there may be instances where you may not have to pay this tax. Mortgage Debt Relief Act At the height of the subprime mortgage crisis, the government passed the Mortgage Debt Relief Act, a bill that prevented taxation by setting mortgages that became unpaid through foreclosures as income. And this bill was originally only valid until 2020, but it is said that the agenda that extends it until 2025 has also been passed. To be eligible for Mortgage Debt Relief, you must meet the following two conditions: It means that the property must be for principal residence, i.e. for actual residence. Second, the amount of debt forgiven cannot exceed $750K. However, even if the house undergoing foreclosure is not for actual residence, there is a way to avoid tax.   • Tips for First Home Buyers

    It is said that the proportion of first home buyers among all house trade buyers in 2022 fell below 30%. For reference, the average from 2011 to 2022 was 40%. Rising house prices, declining supply, and high interest rates are fueling this phenomenon. In this situation, I have brought information that may be of some help to first home buyers. First, the biggest reason first home buyers can't buy a house is the burden of down payments. Interest rates have risen, and house prices have risen, so in order to buy a house you like, of course, the monthly mortgage payment would have to be much higher than the previous year or two years ago. The best way to reduce this payment would be to increase the amount of down payment. In other words, down payments can be more burdensome than before. However, the story of less than 40%, and the story that the ratio of first home buyers is less than 30% in the current real estate market, where the transaction volume is lower than usual, suggests that a much larger number of millennials are unable or unwilling to buy a house than expected. This is the story of buying. Of course, there will be millennials who never buy a house for the rest of their lives. However, the day will come when the majority of millennials who haven't bought their current home will eventually buy one. And, there will surely come a time when the existing demand that is generally formed every year and the demand of these millennials overlap in the market. As we all know, price is formed when supply and demand meet. What if demand increases in the current situation, where there is no way to drastically increase supply? And looking at the current situation, it is obvious whether demand will increase or decrease. Third, don't insist on a private house, but also look for a condo or townhome. Of course, I tell my clients to buy a private house for the future. Because the biggest reason the supply of real estate is getting slower is because there is no land. Owning a parcel is therefore a great investment later on. However, private homes are taxed and expensive to purchase.   • Down payment is not necessarily 20%

    Some people are hesitant to buy a house because the money they saved to make a down payment is less than 20% of the house price they want to buy. But, down payments do not necessarily have to be 20%. So, what percentage of the down payment do other people make? According to research, more than one-third of all buyers raise their money with the misinformation that a downpayment must be 20% or more. This is absolutely not true. In fact, the median down payment hasn't been 20% since 2005. Most mortgage loans do not require a down payment of more than 20%. As you can see in the graph below, the median down payment for buyers these days is 14%. Especially for first home buyers, the median is only 6%. Of course, there are many advantages to having a down payment of 20% or higher. However, I think it is more inefficient to delay buying a house for the sake of those advantages and not be able to keep up with rising house prices. Therefore, rather than waiting to collect 20% of the money from non-experts, it is better to approach it more strategically through consultation with mortgage experts or realtors. More specifically, if you go to the Down Payment Resource site mentioned earlier, you may find a program that helps with down payments. According to the site, 38% of the programs they introduce are programs that can be applied even if you are not a first home buyer.
